On July 1, 2017, Florida enacted a law1 giving both passengers who use these “transportation network companies” (or TNC’s) and drivers who are involved in an automobile accident with a driver from one of these services. Specifically, the law requires TNC drivers to carry a minimum of $50,000 in liability insurance per person and $100,000 in liability insurance per accident if the driver is logged in to the service and waiting for passengers. However, these drivers are also required to carry $1,000,000 in liability insurance for the time in which a passenger is present.
Florida’s new TNC bill provides further protection ensuring that the companies (i.e. Uber, Lyft, Curb, etc.) do not hire drivers who have been:
- Convicted of a DUI, hit-and-run, reckless driving, or other related traffic offenses in the past five years;
- Convicted of driving without a valid driver’s license in the past three years; OR
- Listed in a federal sex crime registry.
While these new insurance requirements and driver regulations provide better protections to those involved in an accident with a TNC driver, it is important take the necessary steps to protect your claim.
